RV Park Permit on Hold as Camping Rules Face Court Test

A conditional use permit (CUP) application for a proposed RV park in Washburn County is on hold amid legal action challenging the county’s amended campground ordinance. The lawsuit, filed last year by the Wisconsin Association of Campground Owners (WACO), raises concerns about the county’s 2023 regulatory changes, which have sparked debate within the state’s outdoor hospitality industry.

WACO’s lawsuit, filed in September, contends that the county lacks a comprehensive plan and that the new ordinance imposes excessive restrictions.

The impact of this legal challenge became apparent when Robert Palmer’s rezone request and CUP application were presented to the Zoning Committee, Newsbreak reported. Palmer had sought to rezone 25 acres in Crystal Township, Springbrook, from Agricultural to Residential Agricultural for a 49-site RV park.

During a recent Zoning Committee meeting, Chair Brian Melton informed Palmer about the ongoing lawsuit, who agreed to a postponement. Committee member Dave Wilson expressed hope for a ruling by December 23, while Melton noted they had been awaiting this decision for some time.

After discussion, the committee opted to reschedule Palmer’s requests to the February 25, 2025, Zoning Committee meeting, allowing time for the lawsuit’s resolution and potential appeals. Palmer concurred that this timeline would be suitable for his project.

Bill Johnson of Washburn County Corporation Counsel explained that state law requires zoning ordinances enacted after January 2020 to align with a comprehensive plan, which must be updated whenever new ordinances are approved.

The ordinance stipulates that campgrounds and resorts in Washburn County are permitted only in designated zoning districts and require an approved CUP from the Washburn County Zoning Committee. This process ensures compliance with local land-use plans and community standards.

In addition to county requirements, campgrounds in Wisconsin must adhere to state regulations, as stated in the county’s Code of Ordinances. Operators are required to obtain a valid permit under Wisconsin Statutes § 97.67 and comply with Wisconsin Administrative Code Chapter ATCP 79, which outlines health and safety standards for campgrounds.

These state regulations cover essential aspects such as sanitation, fire safety, and site maintenance, ensuring the safety of guests and the surrounding community.
