Bill Giving SC Park Owners Authority to Eject Guests Fails to Pass in Senate

A South Carolina (SC) legislation that would have authorized campground owners to remove guests from property with the assistance of law enforcement has failed to move forward from the Senate, according to the Carolinas Association of RV Parks and Campgrounds (CARVC).

“After flying through the House, without a single dissenting vote, the Senate sat on it for over a year. After two hearings and all questions answered, all that was needed was a vote,” the trade association wrote to its members in a May 25 email.

Landlord-Tenant Act, also known as Bill H3765, seeks to amend section 27-40-20 of Code of Laws of South Carolina (1976) to exempt certain tenancies from the act. Part of the bill also pushes for the amendment of section 45-2-60, which would have allowed park operators and owners to request assistance from authorities to remove guests.

Under H3765, which was sponsored by Representatives William M. Bill” Chumley (R- Spartanburg), Steven Wayne Long (R-Spartanburg), and James Mikell “Mike” Burns (R-Greenville), any guest ejected from a campground has ten days to file a claim for property left at the time of removal.

According to CARVC, their lobbyist Rob Chumley, worked for two weeks to bypass the committee and take the bill to the Senate floor before the session ended. Yet, the vote in the Senate never happened.

The legislation was introduced in the House on January 28, 2021 and advanced to the Senate on March 4, 2021.

“CARVC will continue with their efforts in the passage of this bill next year. Strategy will be the same in the House, but in the Senate, a companion bill will be needed,” the group wrote in the membership email.

You know, even though things didn’t pan out in the Senate, CARVC isn’t throwing in the towel. They’re still gunning for that bill that would help park operators out. It’s all about staying optimistic and pushing forward. Let’s see how their persistence pays off in the future!
