Biden Admin Reverses Trump’s Effort to Stop California’s Vehicle Emissions Rules

The Biden administration on Tuesday formally approved a reversal to a rule made by then-U.S. President Trump that sought to stop California’s emission regulations for vehicles.

The Department of Transportation said it will issue final rules to rescind Trump’s decision that sought to block California from establishing vehicle regulations that could conflict with the federal government’s authority to determine Corporate Average Fuel Economy (CAFE) requirements.

The program imposes standards for fuel efficiency.

“States can now actively pursue solutions to address the climate crisis and environmental challenges in their communities,” Transportation Secretary Pete Buttigieg said in a statement.

About two dozen U.S. states sued to stop a couple of Trump actions that sought to exclude California from vehicle emissions regulations as major automakers supported the move.

After Democrat Joe Biden was elected president in November 2020, General Motors Co reversed direction and decided to no longer support the previous administration’s attempt to stop California from defining its own emission rules.

The U.S. Environmental Protection Agency (EPA) is also attempting to reverse Trump administration’s decision to remove California’s legal power to establish rules for vehicle emissions and to set zero-emission vehicle rules.

The EPA in 2013 awarded California an exemption for its greenhouse gas emissions and zero-emission vehicle regulations.

Fourteen other states have adopted California’s vehicle emission regulations and 11 states have adopted its zero-emission vehicle mandates.

On Monday, the EPA approved new vehicle emissions standards until 2026. This will reverse Trump’s rollback of car pollution cuts and accelerate the country’s shift to more electric vehicles (EVs). The new rule will reduce U.S. gasoline consumption by 15 percent by 2050, the EPA stated, which is more than 440 million barrels.

Biden plans to have half of new vehicles sold by 2030 to be EV or plug-in hybrids but has not announced support of California’s plans to eliminate gasoline-powered light-duty engines by 2035.

Next year, the Transportation Department is likely to complete its revision of CAFE standards.
