Conditional-Use Permit Upheld for 200-Unit RV Site on Spooner Lake

After an extensive review and public discourse lasting nearly four years, involving legal challenges and community opposition, the Washburn County Board of Adjustment (BOA) in Wisconsin has upheld the conditional-use permit (CUP) for North Camp Properties LLC.

This decision paves the way for the development of a 200-unit RV site on Spooner Lake, according to an APG Wisconsin report.

Despite the opposition, including detailed input from residents and environmental advocates about the potential adverse effects on Spooner Lake’s ecosystem and water quality, the BOA maintained the permit.

The deliberations considered technicalities around campground definitions, wastewater capacity, and environmental compliance. Notably, concerns were raised about the adequacy of the proposed wastewater system and the calculation of surfaces, which could significantly impact local water bodies and land use compatibility.

The Zoning Committee initially granted North Camp Properties a CUP in 2021 for the construction of a seasonal RV/park model campground close to Spooner Lake, which raised concerns.

Concerns were raised by the Spooner Lake Protection and Rehabilitation District about potential environmental impacts, including water quality and wastewater management, leading to an appeal to overturn the CUP. Despite these concerns, the BOA decided in favor of the development.

The legal journey saw the case escalate to the Bayfield County Circuit Court, where Judge John Anderson initially overturned the CUP, citing due process errors during the zoning hearing. The case was sent back to the BOA for further review, during which significant public input was considered, including concerns over water quality, the definition and standards of campgrounds, and the impact on local ecosystems and community welfare.

The public’s concerns were considered, underscoring the need for stringent oversight and compliance with environmental standards to mitigate any potential negative impacts on the lake and surrounding areas.
